In the UK, the Office for National Statistics (ONS) published data to show that just 22% of autistic adults are in any kind of employment. They also reported that 64% of employers still admit to having ‘little’ or ‘no’ understanding of neurodiverse conditions.

On the 29th May 2024, I am hosting a 30 minute webinar on Neurodiversity in the Workplace. This webinar will start at 1pm on Zoom. To book to attend this free information session, please send me an email to info@sanitashub.co.uk

Neurodiversity

Neurodiversity refers to the idea that neurological differences, such as autism, ADHD, dyslexia, and other conditions, are natural variations of the human brain and should be recognized and respected as such. The concept of neurodiversity emphasizes the value of diversity in the way people think and process information.

The Equality Act is a piece of legislation that prohibits discrimination based on certain protected characteristics, such as disability, in various areas including employment, education, and access to goods and services. In the context of neurodiversity, the Equality Act can provide legal protection for individuals who are neurodivergent, ensuring that they are not discriminated against because of their neurological differences.

Employers, for example, are required to make reasonable adjustments to support neurodivergent employees in the workplace under the Equality Act. This can include providing additional support, making changes to work environments, or offering flexibility in working arrangements to accommodate the needs of neurodivergent individuals.

Overall, the Equality Act plays a crucial role in promoting inclusivity and ensuring that individuals with neurodiverse conditions are treated fairly and have equal opportunities in various aspects of life.

Legal Considerations

In some instances, the nature of the condition can qualify as a disability for the purpose of the Equality Act 2010. Under this legislation, a person has a disability if “they have a physical or mental impairment, and the impairment has a substantial and long term adverse effect on their ability to carry out normal day to day activities”

Managing an Employee with a Neurodivergent Condition

To support and create an equal, diverse and inclusive working environment for neurodiversity, how you manage an employee who has a neurodivergent condition is important. Not only is it the right thing to do morally, but legally it is important that a fair process is implemented to avoid claims of discrimination and/or unfair dismissal.
